Terms of Service

Beheld is an iPhone app that observes your movement and writes about it. These terms describe what you can expect from Beheld, what Beheld expects from you, and the limits of what the app does. Written in plain English, with the legal detail spelled out below.

1. Acceptance

By downloading, installing, or using the Beheld app ("Beheld", "the app"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the app. These Terms form an agreement between you and Beheld, made by eTurea, an independent iOS developer ("we", "us").

These Terms take effect when you download or use Beheld from the App Store.

2. The app

Beheld is a self-writing movement journal for iPhone. It reads movement data from Apple Health on your device and uses that data to generate short daily journal entries. Beheld does not provide medical, fitness, training, coaching, nutritional, or health advice. The journal is a record, not guidance.

3. Your license

Beheld grants you a personal, non-exclusive, non-transferable, revocable license to install and use the app on iPhones you own or control, in accordance with the Apple Media Services Terms and these Terms. You may not reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent applicable law expressly permits.

Your license to use Beheld is also governed by Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA"). These Terms supplement the Apple Standard EULA; if anything in these Terms conflicts with the Apple Standard EULA or the Apple Media Services Terms, those Apple terms control to the extent of the conflict.

4. Apple Health permission

Beheld requires your permission to read movement data from Apple Health. You may grant, restrict, or revoke that permission at any time in the iOS Settings app. Without movement data, Beheld cannot write entries about your movement.

Beheld does not upload your movement history to Beheld, to an ad network, or to any third-party server. Whether your Apple Health data syncs across your devices or is included in device backups is governed by your Apple settings, not by Beheld. For details, see the Privacy page.

5. AI-generated content

Where Apple Intelligence is available, Beheld uses Apple's Foundation Models framework to generate journal text on your device. Where Image Playground is available, postcard images are generated on your device. Generated text and images are produced by a probabilistic model and may contain inaccuracies, repetitions, or phrasing you do not enjoy. Generated content is provided as-is.

You own the journal entries and postcard images generated for you on your device, to the extent permitted by Apple's terms governing Apple Intelligence and Image Playground. You are responsible for any sharing or reuse of that content.

A small library of postcard illustrations bundled with Beheld for use on devices where on-device generation is unavailable was also produced using Apple's Image Playground, prior to shipping. These bundled illustrations are part of the app and are provided for display within Beheld; please do not extract or redistribute them separately.

6. Purchases

Beheld is free to download and use. A one-time in-app purchase unlocks Personalization, which enables more specific personal AI writing.

All purchases are processed by Apple through StoreKit and the App Store. Beheld checks your purchase status on your device using StoreKit and does not run its own server; no purchase information is sent anywhere by Beheld. Beheld does not receive payment card details, billing addresses, or other payment information. The current price may vary by region and is subject to applicable taxes.

The Personalization purchase is one-time. There is no subscription. There is no recurring charge.

7. Refunds

Refund requests for in-app purchases are handled by Apple in accordance with the Apple Media Services Terms. To request a refund, visit reportaproblem.apple.com from a device signed in to your Apple ID. Beheld is not able to issue refunds directly.

8. No account

Beheld does not require an account, sign-in, email address, or profile. You are responsible for the iPhone on which Beheld is installed and for any movement data Apple Health records on that device.

9. Acceptable use

You agree not to: (a) use Beheld to violate any applicable law or the rights of others; (b) attempt to interfere with the app's intended operation; (c) use the app to fabricate or misrepresent records of physical activity for fraudulent purposes; or (d) circumvent any in-app purchase or licensing mechanism.

10. Not medical advice

Beheld is not a medical device, fitness coach, or training program. The app does not diagnose, treat, cure, or prevent any condition, and it does not set goals, score performance, or recommend activity levels. If you are considering changes to your physical activity, consult a qualified professional.

11. Disclaimer of warranties

Beheld is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Beheld does not warrant that journal entries or postcard images will be accurate, useful, or to your taste, or that the app will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Beheld shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the app. Beheld's total cumulative liability to you for any claim arising out of or related to the app shall not exceed the amount you paid for the app in the twelve months preceding the claim, or USD 5.00, whichever is greater.

13. Changes to the app

Beheld may add, change, or remove features at any time. Where reasonable, material changes that affect existing functionality will be announced in the app or on this site. Beheld may also discontinue the app entirely; if that happens, journal entries already stored on your iPhone remain on your iPhone.

14. Changes to these terms

These Terms may be updated from time to time. The "Effective" date at the top of this page reflects the latest revision. Continued use of the app after a revision constitutes acceptance of the revised Terms. If a revision is material, Beheld will make a reasonable effort to call attention to it.

15. Termination

You may stop using Beheld at any time by deleting the app from your iPhone. Because Beheld has no account or server, it cannot remotely disable the app for an individual user. If you materially breach these Terms, the license granted in Section 3 ends automatically — you must stop using Beheld and delete it — and Apple may remove the app or restrict your access through the App Store. Sections that by their nature should survive termination — disclaimers, limitations of liability, governing law — will survive.

16. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Where mandatory consumer-protection laws of your country of residence apply, nothing in these Terms is intended to override those protections.

17. Apple as third-party beneficiary

You acknowledge that these Terms are between you and Beheld, not Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you with respect to your use of the app.
